Notice of Privacy

In compliance with the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations and the Guidelines of the Privacy Notice, Servicios Troncalizados, SA de CV, responsible for the protection and processing of data, with address at Avenida Revolución, number 639, 4th floor, Colonia San Pedro de los Pinos, Postal Code 03800, Mexico, Federal District (“Servitron”), makes this Privacy Notice (the “Notice”) available to any natural person with respect to whom treat your personal data (the “Holder”).

I. Purposes of the Treatment.

The personal data of the Owner will be processed for the purposes described below:

a) Personal data of clients:

1. Provide the services and products required by the Holder.
2. Inform about changes in the services or products provided by Servitron.
3. Inform about new services or products related to Servitron’s corporate purpose.
4. Comply with obligations contracted by Servitron and/or the Holder.
5. Evaluate the quality of the service provided by Servitron.
6. Respond to questions or comments from the Holder.
7. Sending quotes requested by the Holder.
8. Carry out internal studies on the Holder’s consumption habits.
9. For marketing, advertising and commercial prospecting purposes.

The purposes referred to in numbers 3, 5, 6, 7, 8 and 9 are not necessary for the services or products required by the Holder. In the event that the Owner does not want their personal data to be processed for these additional purposes, they may submit their refusal in writing, at Servitron’s address or electronically to the following addresses: daniel.martinez@servitron.net or iliana.moreno @servitron.net.

b) Personal data of candidates and employees:

1. Carry out personnel recruitment and selection processes.
2. Integrate the Holder’s labor file in case of hiring.
3. Comply with the benefits and obligations derived from the employment relationship maintained with the Holder.

II. Personal Data of the Holder.

To fulfill the purposes described in this Notice, Servitron may process the following personal data of the Holder:

a) Personal data of clients: full name, age, sex, address, private telephone number and email, autograph signature, photograph, work telephone number and email, bank account number, credit history and Federal Taxpayer Registry (RFC).

b) Personal data of candidates and employees: full name, age, sex, address, private telephone number and email address, handwritten signature, photograph, work telephone number and email address, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), level of studies, title, professional license, current employment, employment references, social security number, credits contracted with government entities (INFONAVIT or FONACOT) and bank account number.

Servitron will not process sensitive data of the Holder, as they are not necessary to fulfill the purposes described in this Notice.

III. Transfers of Personal Data.

Servitron states that it will not transfer the Holder’s personal information to third parties, unless any of the exceptions provided for in article 37 of the Federal Law on Protection of Personal Data Held by Private Parties is updated. In the event that the Holder’s personal data should be shared with a third party, Servitron undertakes to notify the Holder before they are transferred so that they express their agreement or disagreement in this regard.

IV. ARCO rights.

The Holder at any time may request Servitron access, rectification, cancellation or opposition of their personal data, through the respective request, which must contain the following requirements: 1. Name and address of the Holder; 2. Document that proves the identity of the Holder or, where appropriate, the documents that prove the representation of the same; 3. Clear and precise description of the personal data with respect to which you seek to exercise any of the rights indicated in the previous paragraph; and 4. Any other element that facilitates the identification of personal data. The request must be submitted in writing at Servitron’s address electronically to the following addresses: daniel.martinez@servitron.net or iliana.moreno@servitron.net. Servitron will have the obligation to answer the Holder’s request in writing within a term not exceeding twenty business days from the day of its presentation. The answer will be notified at the address or email indicated by the Holder for this purpose. In cases where the Holder exercises his right of access, Servitron will comply by making his personal data available to the Holder, issuing simple copies, electronic documents or through any other means that allows the Holder to access his personal data.

V. Revocation of Consent.

The consent of the Owner to the processing of their personal data is understood to be granted in accordance with the terms and conditions described in this Notice when the Owner: (i) expressly states it; (ii) does not express any opposition; (iii) expresses its interest in entering into a contract or legal act with Servitron; Y (iv) has a current legal relationship with Servitron.
The Holder may revoke the consent for the processing of their personal data, subject to the mechanisms, requirements and procedures indicated in section IV of this Notice.

SAW. Limitation of Use of Personal Data.

At any time, the owner may limit the use of their personal data for marketing, advertising or commercial prospecting purposes, by sending an email to Publicidad@servitron.net. Once the Holder’s request is received, he will be registered in an exclusion list “Limitation of Use of Personal Data” so that his personal data is not processed for marketing, advertising or commercial prospecting purposes by Servitron.

VII. Use of technologies.

In some sections of the Servitron site, the Holder is required to have cookies enabled to work. Cookies are used to: a) recognize the Holder when entering the sites and offer a personalized experience, b) know the personal configuration of the site specified by the Owner, for example, cookies allow detecting the bandwidth that has been selected when entering the home page of the site, to know what type of information is advisable to download, c) calculate the size of the audience and measure some traffic parameters, since each browser that accesses the site acquires a cookie that is used to determine the frequency of use and the sections of the sites visited, thus reflecting habits and preferences, information which is useful for improving content, headlines, and promotions for the Headline. Cookies also help to track some activities, for example, we can use cookies to detect if the Owner has filled out a survey and avoid displaying it again, in case he has done so. The Owner can disable cookies by following these steps: The “help” button found on the toolbar of most browsers will indicate how to avoid accepting new cookies, how to have the browser notify you when you receive a new cookie or how to disable all cookies; however, cookies allow you to take advantage of the most beneficial features that Servitron offers, so it is recommended to leave them activated. Servitron advises the Holder to update their data every time they undergo any change, as this will allow them to provide a more personalized service of personal information on the Servitron site. Servitron has implemented the administrative, technical and physical security measures that allow personal data to be protected against damage, loss, alteration, destruction or unauthorized use or treatment. Information is stored on a secure server that resides behind a firewall designed to prevent access from outside the company. Once Servitron receives the data, it undertakes to do everything possible to safeguard its security on its systems. The information provided by the Holder is secured by a personal identification number to which only the Holder can access and of which only he is aware. Servitron recommends that the Holder does not reveal his password to anyone, likewise informs him that he will not request his password in any unsolicited phone call or email. At all times, the Holder is Servitron’s sole and final right to keep secret his user/partner number, personal password, access code and confidential number with which he has access to the services and contents of the Servitron site. To reduce risks, Servitron recommends that the Holder log out of his account and close his browser window when he finishes his activity, even more so if he shares his computer with someone or uses a computer in a public place such as a library or an Internet cafe. Once Servitron receives the personal data of the Holder, it will do everything possible to safeguard its security in its systems. On this issue, Servitron have focused their efforts to offer the most modern and up-to-date technology in order to offer you the greatest possible security of the terms.

VII. Changes in the Privacy Notice.

Servitron reserves the right to make changes or updates to this Notice at any time, in response to new legislation or jurisprudence, internal policies, new requirements for the provision or offering of our services or products and market practices. The modifications or updates to this Notice will be available at the address and on the Internet page of Servitron www.servitron.net / privacy notice section. The foregoing, without prejudice to Servitron sending them, where appropriate, to the last email provided by the Holder.

IX. Acceptance of the Terms

This declaration of Confidentiality and Data Protection is subject to the terms and conditions of Servitron, with which it constitutes a legal agreement between the “Holder” and “Servitron”.

If the Holder uses our services, it means that he has read, understood and agreed to the terms set forth above.

X. Complaints.

In the event that the Holder considers that Servitron has violated his rights regarding the protection of personal data, he may file his disagreement with the National Institute of Access to Information and Data Protection (INAI).
